Terms of Service

These Terms of Service ("Terms") govern your use of the TradeStack platform, websites, and services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TradeStack provides an educational and performance-tracking platform for traders. It includes trade journaling, analytics, market data summaries, a learning academy, community features, and an AI process coach. TradeStack does not offer financial, investment, legal, or tax advice and is not a broker-dealer, exchange, or financial institution.

2. Eligibility & Account Registration

• You must be at least 18 years old and legally able to enter into binding contracts.
• You agree to provide accurate, current information and to keep credentials secure.
• You are responsible for all activity that occurs under your account.
• You must promptly notify us of any unauthorized use of your account.

3. User Responsibilities & Acceptable Use

You agree not to:

• Violate any law, regulation, or third-party rights.
• Reverse engineer, scrape, or attempt to extract source code or non-public data.
• Upload viruses, malicious code, or content that infringes intellectual property.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Use the Service to harass, threaten, or harm others.
• Share or post stock recommendations, "trade signals", or financial advice in community areas.

4. Subscriptions & Billing

TradeStack offers Free, Pro, and Elite plans. Paid plans renew automatically at the end of each billing period at the then-current rate unless canceled. Pricing and features may change with notice.

• Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis.
• You can update or cancel your subscription at any time from Plans & Billing.
• Taxes may apply based on your billing location.

5. Cancellation Policy

You may cancel at any time. Cancellation takes effect at the end of your current billing period and you will retain access to paid features until that date. We do not delete your data on cancellation; you remain on the Free tier with read-only access where applicable.

6. Refund Policy

Except where required by law, all payments are non-refundable. We may, at our sole discretion, issue partial refunds in cases of duplicate charges, accidental upgrades within 72 hours of purchase, or extended Service outages. Refund requests can be sent to support@tradestack.app.

7. Intellectual Property

The Service, including all software, designs, text, graphics, logos, and trademarks, is owned by TradeStack or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. You retain ownership of content you upload (journal entries, screenshots, notes) and grant us a license to host and display that content solely to operate the Service for you.

8. AI Coach Output

The AI Trading Coach generates text using third-party large language models. Output is provided for educational and process-coaching purposes only, may contain errors, and must not be relied upon for trading decisions. You are solely responsible for verifying any information before acting on it.

9. Third-Party Services

The Service integrates with third parties (e.g., Stripe for payments, OpenAI for the AI Coach, Finnhub for market data, Google for sign-in). Your use of those services is governed by their respective terms and privacy policies.

10. Account Termination

We may suspend or terminate your account for violations of these Terms, fraudulent or unlawful activity, or extended inactivity. You may delete your account at any time by contacting support@tradestack.app. Upon termination, license rights granted to you cease immediately.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRADESTACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESTACK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR TRADING LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO TRADESTACK IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold TradeStack harmless from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any right you have under your local consumer protection laws.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app banner. Continued use of the Service after the changes take effect constitutes acceptance.
